Since the EPC was first established, there has been ongoing debate within the Boards of Appeal about how patent claims should be interpreted—strictly on their wording alone or with support from the description. With decision G1/24, the Enlarged Board of Appeal was finally asked to provide definitive guidance on this important question.
However, the Enlarged Board’s order has left many wondering whether a real opportunity for clarity was missed—or whether meaningful change was ever likely.
